Appeals Officer Upholds the Planning Commission's Issuance of Conditional Use Permit to Viresco Energy
3/16/2012After a review of hundreds of documents, a hearing lasting over 3 hours, and over a month of deliberations, the Kanab Appeals Officer has denied an appeal by the Kane County Tax Payers Association (TPA) challenging the Kanab City Planning Commission’s issuance of a Conditional Use Permit to Viresco Energy. The full decision, available HERE, dismisses all the arguments presented by the TPA, stating unequivocally that the Planning Commission did not act arbitrarily or illegally, as had been accused.
The Permit allows Viresco to exceed the height limitations in the M-2 zone for two smokestacks if the applicant meets seven conditions. The conditions cover areas such as emissions, appearance, safety, and removal of the smokestacks if operations cease.
This is the 3rd appeal brought forward by the TPA regarding land use decisions over the last year, and in each instance, the City’s actions have been upheld after careful review.
